Fixed Restraints Violate JDAI Values, Due Process and Accepted Standards
JDAI leaders at the Youth Law Center and the Center for Children’s Law and Policy address the use of fixed restraints in "Moving Away from Hardware: The JDAI Standards on Fixed Restraints.” The paper specifically examines how the use of fixed restraints violates constitutional due process standards, accepted standards of professional practice and core JDAI values. Citing the harm they cause youth and/or staff, and potential litigation and negative public attention, the paper emphasizes how fixed restraints represent an extreme measure that should be removed from the detention continuum. The publication is the first in a series of papers examining conditions-of-confinement issues. The series is meant to educate JDAI facility self-assessment teams and assist in shaping professional practice for facility staff and administrators, officials with the responsibility for developing state standards and colleagues in organizations that promulgate juvenile institutional standards.
